TO
Empower the Ministry of Urban Development to Enact its Lawful Duties

Preamble: Following its redefinition in the Criminal Code Reformation Act, MUD is legally prevented from enacting property inspections without the high risk of being charged with trespass. This bill will give MUD presumptive permission to inspect properties provided no refusal is noted within a minimum notice period.

1. Empowerment
(a) MUD employees will be granted legal access to all properties in Azalea solely to conduct property inspections to ensure compliance with the law.
(i) Plot owners and tenants must be given 72 hours notice before any inspection takes place.
(b) Plot owners can refuse to grant access for the inspection to take place.
(i) This refusal must be given in the 72 hour notice period.
(ii) If no refusal is received, MUD employees are free to enter the property to conduct an inspection without fear of reprisal.

(c) If refusal is received, MUD may request a warrant from a district judge to gain access to inspect.
(i) If a warrant is granted, an inspection may take place immediately without the 72 hour notice period.

2. Penalty
(a) Any MUD employees abusing this access will be suspended from their role pending an investigation by the MoJ.
(i) If the Ministry decides against bringing charges, the suspended employee will be reinstated.
(ii) If the case goes to court, the employee will be removed from their position for bringing the ministry into disrepute, regardless of criminal outcome.


Enactment: This Act comes into force immediately upon passage.
