Type: Amendment to an Act

A
BILL
TO
AMEND THE FREEDOM OF INFORMATION ACT

Preamble: The purpose of this amendment is to streamline public access to government records, minimise procedural barriers and reform archaic requirements.

1. Short Title and Enactment
(a) This bill shall be referred to as the "Freedom of Information Accessibility Act"
(b) This amendment comes into force immediately upon passage.

2. Fee Justification and Waiver
(a) Section 7(a) of the Freedom of Information Act is amended by replacing ""individuals may submit no more than three free requests per month. They may pay $1,000 per request to submit up to an additional two, for five total, and after that they may not submit any additional requests until the next month begins."" to ""individuals may submit no more than four free requests per month. A Responding Office may charge a fee of up to $1,000 per request for up to four additional requests per month, provided that the Responding Office delivers a written justification detailing why fulfilling the additional request imposes an extraordinary operational burden. This means a monthly total of eight requests allowed.""
(b) Section 5(b) of the Freedom of Information Act is amended by adding a new clause (a)(ii) ""If an individual is assessed a fee under section 7(a) for an additional request, the individual may petition the Court to waive the fee. The presiding judge shall waive the fee if the citizen demonstrates that the request serves a substantial public interest or if the Responding Office fails to prove that the request creates an extraordinary burden.""

3. No longer Needed Clause
(a) Section 7(c) of the Freedom of Information Act is amended by removing ""These limits shall apply to requests already filed in December, although the fines shall not if an individual is already over the three requests."" to avoid future confusions around ""December"" since there is no year evens though it was intendeds for December 2025.

4. Streamlining
(a) Section 4(a) of the Freedom of Information Act is amended by replacing ""If the citizen does not know which office to contact, they may open a ticket with any Responding Office and that office should help facilitate connection with the appropriate Responding Office."" to ""If a ticket is opened with an incorrect Responding Office, that office shall internally forward the request to the correct Responding Office without requiring the citizen to file a new request.""
(b) Section 7 of the Freedom of Information Act is amended by adding a new clause ""If an individual is asks a follow up question to the same request, it shall not be considered a new request unless the nature of the question is non-reasonable unrelated request. Reasonable related follow up questions can include: questions about the information provided, questions about scope and questions about how the information was acquired.""
