Establish Classifications of Crimes


Preamble: This bill re-clarifies the Ministry of Justice’s authority around arrests.


1. Misdemeanours
(a) Anyone arrested for charges with a punishment up to 60 minutes in jail, or a total fine of $5,000, will be considered a misdemeanour.
(b) Any arrests resulting in charges greater than these amounts will be considered a felony.

2. Police Punishment
(a) In any instance where a citizen’s alleged crimes would qualify as a misdemeanour, police may apply the punishment prior to a trial.
(i) Those charged with felony offences can still be held on remand in jail, but these cases must be heard before a judge.
(ii) Fines may not be issued on felonies until found guilty in a court of law.
(iii) Citizens held on remand who are later found not-guilty will be entitled to compensation totalling no more than 150% of the per second bail rate.
(iv) Bail shall be set at a cost of $1 per second.
(v) Crimes outside of crimes against the person, against property, against the public order, or use of illicit items, should be litigated, unless exceptional circumstances exist.


3. Limit Suspension
(a) Section 10 of the Criminal Code shall be suspended, as shall the entirety of 11a. This means they shall no longer be in force or legally binding.

Enactment: This Act comes into force immediately upon passage.
