AMEND THE NEW CRIMINAL CODE ACT
Preamble: This bill shall set proper Contest procedures.
1. Naming and Authors
(a) This Act shall be named “The Criminal Contests Act”.
(b) This Act was authored by Doğan Karaca and Phoenix Flamesong.
2. Amendments
(a) Section 12 (a) of the New Criminal Code Act shall be amended as follows:
(i) (i) If an individual states upon arrest that they wish to contest, is informed of how to do so, and then fails to open a ticket to contest over the following three minutes, the individual waives their right to contest.
(ii) Suspects have 24 hours, from the time they open their ticket to contest, to provide their refutation of the charges against them, including any evidence or proof that supports the argument they make.
(iii) If a suspect has a resisting arrest charge, they are deemed a flight risk and wave their right to contest.
(iv) If a suspect is found to be guilty of a crime, while still having a ticket open to contest another crime, the contest shall be invalidated and the suspect will be guilty of the crime they were seeking to contest.
(v) The Ministry of Justice shall review the contest ticket and the evidence / arguments provided.
(vi) If the Ministry of Justice determines that guilt beyond a reasonable doubt does not exist, the charges shall be dropped. If the Ministry believes guilt beyond a reasonable doubt does exist, the individual shall be charged with the contested crime.
(vii) If the suspect believes this procedure was violated, or that guilt beyond a reasonable doubt does not exist, the suspect may file a lawsuit in court to make their case about that belief.
Enactment: This Act comes into force immediately upon passage.
